Rules, terms and conditions
§ 1 General Rules
1.1. The organizer of the competition is the operator of the website veryniceguitars.com – Wojciech Jarosz “Orzechsoft” based in Kielce, ul. Artura Grottgera 2, 25-441, NIP: 9591930556, hereinafter referred to as “Orzechsoft”, “Organizer Competition” or the “Organizer”.
1.2. The competition lasts from April 22nd, 2025 to May 15th, 2025.
1.3. The competition takes place in Poland. Submissions from outside Poland are possible.
1.4. These Regulations define the rules for conducting the Competition consisting in the Competition Participant sending an application for using the submission form available on the website veryniceguitars.com/2025guitarcontest containing the content indicated in § 4.1 of these Regulations during the Competition.
1.5. Definitions:
The terms used in these Regulations mean:
Regulations – these regulations;
Competition – the competition described in these Regulations;
Veryniceguitars.com portal – websites and other online tools made available via the Internet, used by “Orzechsoft” and available at veryniceguitars.com or elsewhere Internet address used by “Orzechsoft”;
Profiles of the veryniceguitars.com portal – profiles belonging to the Organizer in social networks YouTube, Facebook and Instagram with URLs: youtube.com/@VeryNiceGuitars , facebook.com/veryniceguitars and instagram.com/very.nice.guitars
Competition Participant – User who registers to participate in competition;
User — a person using the veryniceguitars.com Portal;
§ 2 Rules of participation in the Competition
2.1. The competition is intended only for adult Users of veryniceguitars.com who follow the portal’s media profiles social media (Facebook, Instagram and YouTube) and subscribe to veryniceguitars.com’s newsletter.
2.2. Those entities cannot participate in the Competition: Employees and representatives of the Competition Organizer and their family members up to the second degree kinship, and other entities directly involved in preparing and conducting the Competition at the request of the Organizer.
2.3. Followers of veryniceguitars.com profiles who meet the above criteria can take part in the Competition by registering on the website competition at: veryniceguitars.com/2025guitarcontest providing your personal data in the form of: name, surname and e-mail address.
2.4. You can only take part in the Competition once. A person can participate in the Competition only from one online account, regardless of how many e-mail accounts they have.
2.5. Applications for the Competition completed incorrectly and incompletely or containing false data will not be taken into account.
2.6. By participating in the Competition, you accept its rules provided for in these Regulations.
2.7. The organizer reserves the right not to accept applications to Competition that did not arrive on time for reasons independent of them, including due to failure of internet connections or system of the Competition Participant.
2.8. Providing false data in the application to the Competition may result in may result in exclusion from the Competition or withdrawal of the right to a prize.
2.9. One (1) Participant will be awarded. The prize in the competition is the right to obtain a discount allowing you to purchase a used electric guitar Ibanez RGDIX6MPB-SBB with a soft case via veryniceguitars.com for PLN 1 or €1 or USD 1.
3.10. The winner bears the costs of shipping the prize from the Organizer’s office to their place of residence as well as all the applicable import taxes.
§ 3 Rules for awarding competition prize
3.1. The competition task is to prepare a graphics material depicting the Participant’s guitar and the story behind it – what makes it special and how did the Participant acquire it. The image needs to be shared on the Participant’s social media profile, include a link to the Organizer’s profile and a #veryniceguitars2025contest tag. Then, the Participant needs to submit the form available at https://veryniceguitars.com/2025guitarcontest . In particular, the Organizers expect creative and high quality images, stories and posts.
3.2. Our reporting system is equipped with mechanisms that which detect illegal attempts to send multiple reports by the same User. Such votes will be considered invalid.
3.3. By sending the entry, the Competition Participant declares that it is their own authorship and that they have exclusive and unlimited rights copyright to the Entry. The Competition Participant declares that the Entry does not violate legal provisions or legally protected rights of persons or third parties or rights in intangible property. The Competition Participant grants the Organizer all rights to the Entry, including but not limited to the right to distribute, reproduce and share the Entry over various media channels, especially social media profiles belonging to the Organizer.
3.4. The criterion for selecting the winner is selecting the most creative and impressive Submission. The Competition Committee will choose the most creative and impressive (in the opinion of the Competition Committee) Submission. The competition is conducted by the Competition Commission appointed by the Organizer, consisting of the Organizer’s Representatives.
3.5. The Commission will supervise the proper conduct of the Competition Competition panel composed of representatives of the Organizer. From the activities of the Commission a protocol will be prepared, detailing the Competition Winner.
3.6. Committee meeting during which the award will be granted will take place by: May 15th, 2024 in the Competition one Participant will be awarded.
3.7. The prize in the Competition specified in point 2.9. above is not subject to exchange for its equivalent in cash or for any other type of prize.
3.8. The winner of the competition cannot transfer the right to receive the prize to third parties.
3.9. The Organizer can decide to award other participants of the competition with less valuable prizes at the discretion of the Organizers.
§ 4 Announcement of results and distribution of prizes in the Competition
4.1. Information about the results of the Competition will be posted on the website veryniceguitars.com and on profiles in the website’s social networks by May 15th, 2024
4.2. The winner of the Competition will be informed about the winnings and the method to claim their prize via email, the winner is obliged to reply to the email with their address details no later than 48 hours from the date of receipt of the information about winnings.
4.3. In order to receive the prize, the winner must provide: the following data: name, surname, residential address with postal code and telephone number.
4.4. The Competition Winner may express separate voluntary consent to publication of his personal data in the form of name and surname on the website Competition – such consent is expressed by the Winner via e-mail. If the Winner does not give consent – information about the victory will remain posted on the Competition website in an anonymized form, i.e. via publishing the first letter of the name and the town the winner has sent by e-mail in accordance with point 5.2. (e.g. A. from Warsaw).
4.5. If the winner cannot be contacted or fails to meet the requirements set out in the selection procedure above winner will be repeated in accordance with the provisions of point 4.2 of the Regulations.
4.6. Providing false or incomplete data (name, surname and residential address, telephone number) will constitute the reason for refusal of issuing the prize to the Participant if they win.
4.7. The prize can only be awarded to the person who complies all conditions of the Competition described in these Regulations.
4.8. Once the data verification process is completed, the Winner will be informed by the Organizer about how to collect the prize.
§ 5 Complaint procedure
5.1. Any complaints regarding the way the Competition was conducted Participants may submit electronically no later than the deadline 14 days from the end of the Competition. About meeting the deadline for filing complaint is determined by the date of its receipt by the Organizer.
5.2. The complaint should include: name, surname and detailed address Participant, as well as a detailed description and reason for the complaint. Complaints submitted electronically should be sent to: info@veryniceguitars.com. Email subject: “Complaint: VNG 2025 Guitar Contest”.
5.3. Complaints will be considered within 14 days from the date they were received by the Organizer.
5.4. Complaints will be considered on the basis of these Regulations.
5.5. A response to a complaint submitted electronically will be provided sent to the User to the address provided by the User in the complaint within 14 days from the date of consideration of the complaint.
§ 6 Processing of personal data
6.1. The personal data of the Competition Participants is processed in accordance with the regulations on the protection of personal data.
6.2. The administrator of personal data provided by Participants is the Organizer of the Competition.
6.3. The Organizer processes data for the purposes necessary to carry out the Competition personal data of the Competition Participant provided by him in the form registration referred to in § 2 of the Regulations (point 2.3 of the Regulations), in accordance with art. 6(1)(b) of the Regulation of the European Parliament Council (EU) 2016/679 of 27 April 2016 (GDPR).
6.4. For the technical purpose of shipping prizes, the winners’ data will be forwarded to the courier or postal company carrying out the delivery of the prize.
6.5. Providing data is voluntary and the person providing the data has the right to do so the right to access data, the right to correct it, the right to delete data, expressing objection to processing, as well as the right to submit a complaint to the supervisory authority personal data protection – the President of the Personal Data Protection Office. In the extent to which the above-mentioned the data is processed for the purpose of implementing the competition (Regulations) – you also have the right to transfer data. § 7 Final Statements
7.1. These Regulations are available on the website: https://veryniceguitars.com/2025guitarcontest
7.2. These Regulations constitute the only document specifying the rules of the Competition. All promotional and advertising materials are of informative nature.
7.3. Any disputes arising from the performance of obligations related to The competition will be decided by the Court.
§ 1 Postanowienia ogólne
1.1. Organizatorem konkursu jest
operator witryny veryniceguitars.com – Wojciech Jarosz „Orzechsoft” z siedzibą w Kielcach, ul. Artura Grottgera 2, 25-441, NIP: 9591930556, zwany dalej „Orzechsoft”, „Organizatorem Konkursu”, lub „Organizatorem”.
1.2. Konkurs organizowany jest w dniach: 22.04.2025 r. – 15.05.2025 r.
1.3. Miejscem konkursu jest terytorium Polski.
1.4. Niniejszy Regulamin określa zasady przeprowadzania Konkursu polegającego na przesłaniu przez Uczestnika Konkursu zgłoszenia za pomocą formularza konkursowego zamieszczonego w serwisie veryniceguitars.com/2025guitarcontest zawierającego treść wskazaną w § 4.1 niniejszego Regulaminu w terminie trwania Konkursu.
1.5. Definicje:
Przez terminy użyte w niniejszym Regulaminie rozumie się:
Regulamin — niniejszy regulamin;
Konkurs — konkurs opisany w
niniejszym Regulaminie;
Portal veryniceguitars.com —strony i inne narzędzia internetowe udostępniane za pośrednictwem sieci Internet, wykorzystywane przez „Orzechsoft” i dostępne pod adresem veryniceguitars.com lub pod innym adresem internetowym wykorzystywanym przez „Orzechsoft”;
Profile portalu veryniceguitars.com — należące do Organizatora profile w sieciach społecznościowych YouTube, Facebook oraz Instagram o adresach: youtube.com/@VeryNiceGuitars , facebook.com/veryniceguitars oraz instagram.com/very.nice.guitars
Uczestnik Konkursu — Użytkownik, który zgłosi się do udziału w Konkursie;
Użytkownik — osoba korzystająca z Portalu veryniceguitars.com;
§ 2 Zasady uczestnictwa w Konkursie
2.1. Konkurs jest przeznaczony wyłącznie dla pełnoletnich Użytkowników Portalu veryniceguitars.com obserwujących profile portalu na mediach społecznościowych (YouTube, Facebook oraz Instagram) oraz subskrybujących newsletter portalu veryniceguitars.com .
2.2. Uczestnikami Konkursu nie mogą być pracownicy i przedstawiciele Organizatora Konkursu oraz członkowie ich rodzin do drugiego stopnia pokrewieństwa, oraz innych podmiotów biorących bezpośredni udział w przygotowaniu i przeprowadzeniu Konkursu na zlecenie Organizatora.
2.3. Obserwujący profile veryniceguitars.com spełniający powyższe wymagania mogą wziąć udział w Konkursie, rejestrując się na stronie konkursowej pod adresem: veryniceguitars.com/2025guitarcontest podając swoje dane osobowe w postaci: imienia, nazwiska oraz adresu e-mail.
2.4. W Konkursie można wziąć udział tylko raz. Dana osoba może wziąć udział w Konkursie tylko z jednego konta internetowego, niezależnie od tego, ile kont e-mailowych posiada.
2.5. Zgłoszenia do Konkursu wypełnione nieprawidłowo, w sposób niepełny lub też zawierające nieprawdziwe dane nie będą uwzględniane.
2.6. Zgłoszenie udziału w Konkursie oznacza akceptację jego zasad przewidzianych w niniejszym Regulaminie.
2.7. Organizator zastrzega sobie prawo do nie przyjęcia zgłoszeń do Konkursu, które nie dotarły do niego w odpowiednim terminie, z przyczyn od niego niezależnych, m.in. wskutek awarii łączy internetowych czy systemu Uczestnika Konkursu.
2.8. Podanie w zgłoszeniu do Konkursu nieprawdziwych danych skutkować może wykluczeniem z Konkursu lub odebraniem prawa do nagrody.
2.9. Nagrodzony zostanie 1 Uczestnik. Nagrodą w konkursie jest prawo do uzyskania zniżki pozwalającej na zakup używanej gitary elektrycznej Ibanez RGDIX6MPB-SBB wraz z miękkim futerałem w serwisie veryniceguitars.com za 1zł lub 1€ lub 1USD brutto.
2.10. Nagrodzony ponosi koszty wysyłki nagrody z siedziby Organizatora do swojego miejsca zamieszkania.
§ 3 Zasady przyznawania nagród Konkursowych
3.1. Zadaniem konkursowym jest stworzenie przez siebie materiału graficznego wykonanego przez Uczestnika przedstawiającego należącą do niego gitarę i historię opisującą dlaczego ta gitara jest dla Uczestnika ważna i jak wszedł w jej posiadanie. Uczestnik następnie publikuje zgłoszenie na swoich mediach społecznościowych (Facebook lub Instagram, Tiktok lub Discord) wraz z tekstem podanym na stronie oraz odnośnikiem do profili w mediach społecznościowych Organizatora. Następnie koniecznym jest przesłanie zgłoszenia za pomocą udostępnionego formularza na stronie veryniceguitars.com/2025guitarcontest (dalej: Zgłoszenie lub Zgłoszenie Konkursowe)
W szczególności Organizatorzy oczekują kreatywnych oraz imponujących Zgłoszeń.
3.2. Nasz system do wysyłania zgłoszeń został wyposażony w mechanizmy, które wykrywają nieregulaminowe próby wielokrotnego wysyłania zgłoszeń przez tego samego Użytkownika. Takie głosy uznawane będą za nieważne.
3.3. Uczestnik Konkursu wysyłając zgłoszenie oświadcza, że jest ono jego autorstwa oraz że przysługują mu wyłączne i nieograniczone prawa autorskie do Zgłoszenia. Uczestnik Konkursu oświadcza, iż Zgłoszenie nie narusza przepisów prawa, prawem chronionych dóbr osób lub
podmiotów trzecich ani też praw na dobrach niematerialnych. Uczestnik Konkursu przekazuje Organizatorowi wszelkie prawa autorskie do Zgłoszenia, w szczególności na potrzeby rozpowszechniania, kopiowania, zmiany oraz publikacji w Internecie oraz innych mediach.
3.4. Kryterium wyłonienia Zwycięzcy jest nadesłanie najciekawszego Zgłoszenia zdaniem Komisji Konkursowej. Komisja Konkursowa wybierze najciekawsze Zgłoszenie.
Konkursowych dokonuje Komisja Konkursowa powołana przez Organizatora, składająca się z Przedstawicieli Organizatora.
3.5. Nad prawidłowością przebiegu Konkursu czuwać będzie Komisja Konkursowa złożona z przedstawicieli Organizatora. Z czynności Komisji zostanie sporządzony protokół, z wyszczególnieniem Zwycięzcy Konkursu.
3.6. Posiedzenie Komisji, podczas którego nastąpi przyznanie nagrody Konkursowej, odbędzie się w terminie do: 15.05.2024 r. W Konkursie Nagrodą Główną Nagrodzony zostanie jeden Uczestnik.
3.7. Nagroda w Konkursie określona w pkt. 3.9. powyżej nie podlega wymianie na jej równowartość w pieniądzu ani na nagrody innego rodzaju.
3.8. Zwycięzca Konkursu nie może przenieść prawa do otrzymania nagrody na osoby trzecie.
3.9. Organizator może zadecydować o przyznaniu nagród dodatkowych w finalistom konkursu.
§ 4 Ogłaszanie wyników i wydanie nagród w Konkursie
4.1. Informacja o wynikach Konkursu zostanie umieszczona na stronach veryniceguitars.com i na profilach w sieciach społecznościowych serwisu w dniu 15.05.2025 r.
4.2. Zwycięzca Konkursu zostanie poinformowany o wygranej oraz sposobie odbioru nagrody za pomocą wiadomości e-mail, aby otrzymać nagrodę, zwycięzca jest zobowiązany przesłać za pomocą zwrotnej wiadomości e-mail swoje dane adresowe nie później niż 48 godz. od daty otrzymania
informacji o wygranej.
4.3. Zwycięzca, aby mógł otrzymać nagrodę, zobowiązany jest podać następujące dane: imię, nazwisko, adres zamieszkania z kodem pocztowym oraz numer telefonu.
4.4. Zwycięzca Konkursu może wyrazić odrębną dobrowolną wyraźną zgodę na publikację jego danych osobowych w postaci imienia i nazwiska na stronie Konkursu — zgodę taką Zwycięzca wyraża poprzez e-mail. Jeśli Zwycięzca nie wyrazi przedmiotowej zgody — informacje o zwycięstwie zostaną zamieszczone na stronie Konkursu w postaci zanonimizowanej tj. poprzez opublikowanie pierwszej litery imienia oraz miejscowości, które zwycięzca przesłał w wiadomości e-mail zgodnie z punktem 4.2. (np. A. z Warszawy).
4.5. W przypadku braku możliwości skontaktowania się ze zwycięzcą lub nie spełnienia wymogów podanych w punktach powyżej procedura wyboru zwycięzcy powtórzy się zgodnie z postanowieniami punktu 3.5 Regulaminu.
4.6. Podanie nieprawdziwych lub niekompletnych danych (imienia, nazwiska i adresu zamieszkania, numeru telefonu) będzie stanowić przyczynę odmowy wydania Uczestnikowi nagrody w przypadku wygranej.
4.7. Nagroda główna może zostać przyznana jedynie osobie, która spełni wszystkie warunki Konkursu opisane w niniejszym Regulaminie.
4.8. Po zakończeniu procesu weryfikacji danych Zwycięzca zostanie poinformowany przez Organizatora o sposobie odbioru nagrody.
§ 5 Postępowanie reklamacyjne
5.1. Wszelkie reklamacje dotyczące sposobu przeprowadzenia Konkursu Uczestnicy mogą składać drogą elektroniczną nie później niż w terminie 14 dni od dnia zakończenia Konkursu. O zachowaniu terminu do wniesienia reklamacji decyduje data jej otrzymania przez Organizatora.
5.2. Reklamacja powinna zawierać: imię, nazwisko i dokładny adres Uczestnika, jak również dokładny opis i powód reklamacji. Reklamacje składane drogą elektroniczną należy przesłać na adres: info@veryniceguitars.com.Tytuł e-maila: „Reklamacja: VNG Guitar Contest”.
5.3. Reklamacje rozpatrywane będą w terminie 14 dni od dnia ich otrzymania przez Organizatora.
5.4. Reklamacje rozpatrywane będą na podstawie niniejszego Regulaminu.
5.5. Odpowiedź na reklamację złożoną drogą elektroniczną zostanie przesłana do Użytkownika na adres podany przez Użytkownika w reklamacji w terminie 14 dni od daty rozpatrzenia reklamacji.
§ 6 Przetwarzanie danych osobowych
6.1. Przetwarzanie danych osobowych Uczestników Konkursu odbywa się zgodnie z przepisami dotyczącymi ochrony danych osobowych.
6.2. Administratorem danych osobowych udostępnianych przez Uczestników Konkursu jest Organizator.
6.3. Organizator w celu niezbędnym do realizacji Konkursu, przetwarza dane osobowe Uczestnika Konkursu podane przez niego w formularzu rejestracyjnym, o którym mowa w § 2 Regulaminu (pkt 2.3. Regulaminu), zgodnie z art. 6 ust.1 lit b) Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. (RODO).
6.4. W celu technicznej realizacji wysyłki nagród, dane Zwycięzców Konkursu zostaną przekazane firmie kurierskiej lub pocztowej, celem doręczenia nagrody.
6.5. Podanie danych jest dobrowolne, a osobie podającej dane przysługuje prawo dostępu do danych, prawo sprostowania danych, prawo ograniczenia przetwarzania, prawo usunięcia danych, wyrażenie sprzeciwu wobec przetwarzania, a także prawo złożenia skargi do organu nadzorczego ochrony danych osobowych — Prezesa Urzędu Ochrony Danych Osobowych. W zakresie, w jakim ww. dane są przetwarzane w celu realizacji konkursu (Regulamin) — przysługuje Ci także prawo do przenoszenia danych. § 7 Postanowienia Końcowe
7.1. Niniejszy Regulamin dostępny jest na stronie serwisu: https://veryniceguitars.com/2025guitarcontest
7.2. Niniejszy Regulamin stanowi jedyny dokument określający zasady Konkursu. Wszelkie materiały promocyjno-reklamowe mają wyłącznie charakter informacyjny.
7.3. Wszelkie spory wynikłe z tytułu wykonania zobowiązań związanych z Konkursem będą rozstrzygane przez Sąd
